Terms of Service

1. Acceptance of Terms and Acknowledgment

By accessing and using CreatorZen AI ("the Service" or "the Application"), you accept and agree to be bound by the terms and provision of this agreement. This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and CreatorZen AI ("Developer") for the CreatorZen AI mobile application software.

Important: The Application is licensed, not sold, to you by Developer for use strictly in accordance with the terms and conditions of this EULA.

2. Scope of License

Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the Application on Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service.

Permission is granted to temporarily use the Service for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials;
  • Use the materials for any commercial purpose or for any public display (commercial or non-commercial);
  • Attempt to reverse engineer any software contained in the Service;
  • Remove any copyright or other proprietary notations from the materials;
  • Transfer the materials to another person or "mirror" the materials on any other server.

3. Prohibited Activities

You are expressly prohibited from:

  • Scraping or Crawling: Using automated tools, bots, or scripts to access, scrape, crawl, or extract data from the Service
  • Reverse Engineering: Attempting to reverse engineer, disassemble, or decompile any part of the Service
  • Unauthorized Access: Attempting to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks
  • API Abuse: Making excessive or automated requests to our API endpoints
  • Data Mining: Using the Service for data mining, machine learning training, or similar purposes without explicit permission
  • Commercial Use: Using the Service for commercial purposes without a valid commercial license

4. Maintenance and Support

Developer is solely responsible for providing any maintenance and support services for the Application. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

5. Warranty Disclaimer

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee that the Application will be uninterrupted, secure, or error-free.

6. Product Claims

Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

7. Intellectual Property Rights

You acknowledge that the Application contains proprietary content, information, and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, trademark, patent, trade secret, and other intellectual property laws. The Service and its original content, features, and functionality are and will remain the exclusive property of CreatorZen AI and its licensors. The Service is protected by copyright, trademark, and other laws.

8. User Content

You retain ownership of any content you create using the Service. However, by using the Service, you grant us a limited license to store and process your content solely for the purpose of providing the Service.

9. Subscription and Payment

Some features of the Application may require a paid subscription. By subscribing, you agree to pay all fees associated with your subscription. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscription in your Apple Account settings. Subscriptions are subject to Apple's standard terms and conditions.

10. Wellness Disclaimer

CreatorZen is designed to help you organize content and support your wellbeing, but it is not a substitute for professional medical, psychological, or therapeutic advice, diagnosis, or treatment. You acknowledge that all information, coaching prompts, insights, and other guidance provided through CreatorZen are for general informational purposes only. Always seek the advice of a qualified healthcare provider with any questions you may have about a medical or mental health condition, and never disregard professional advice or delay seeking it because of something available in the Service. If you believe you may be experiencing a medical emergency, contact your doctor or emergency services immediately.

11. Limitation of Liability

IN NO EVENT SHALL CREATORZEN AI, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF THE APPLICATION.

12. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, you must cease all use of the Application and destroy all copies of the Application.

14. Third Party Beneficiary

You and Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.

15. Privacy

16. DMCA Compliance

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact us at legal@creatorzen.ai with the following information:

  • A description of the copyrighted work that you claim has been infringed
  • A description of where the material is located on the Service
  • Your contact information
  • A statement that you have a good faith belief that the use is not authorized
  • A statement that the information is accurate and that you are the copyright owner or authorized to act on their behalf

17. Changes to Terms

Developer reserves the right to modify this EULA at any time. Your continued use of the Application after any such changes constitutes your acceptance of the new EULA. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
